Agreement to Terms

These Terms of Service (“Terms”) govern your use of the website gregbuildsny.com and any services provided by Kirkmont LLC, doing business as Greg Builds (“we,” “us,” or “our”). By accessing our website or engaging our services, you agree to be bound by these Terms.

If you do not agree to these Terms, please do not use our website or engage our services.

About Our Services

Greg Builds provides custom steel building design consultation, materials, and professional installation services for residential and agricultural customers in Western and Central New York. Our services include:

• Custom steel garages, workshops, and agricultural buildings
• Professional installation using our own in-house crew
• Project consultation and custom quoting

Services not included: We do not provide site preparation, grading, concrete work, or permit acquisition. These are the responsibility of the customer unless separately agreed to in writing.

Quotes and Pricing

All quotes provided by Greg Builds are valid for 30 days from the date of issue unless otherwise stated in writing. Pricing is based on current material costs, project specifications, and site conditions. We reserve the right to adjust pricing if site conditions differ materially from what was represented at the time of quoting.

All pricing is in U.S. dollars. Taxes, permit fees, and concrete or site preparation costs are not included in our building quotes unless explicitly stated.

Deposits and Payment

Accepted payment methods will be confirmed at the time of agreement. We reserve the right to pause or halt work if payment obligations are not met per the agreed schedule.

Customer Responsibilities

By engaging our services, you agree to the following responsibilities:

• Site preparation: The installation site must be level (within 3 inches), clear of obstacles, and accessible by truck and equipment prior to our crew’s arrival.
• Concrete foundation: A suitable concrete slab or approved foundation must be in place before installation begins, unless gravel installation has been specifically agreed upon in writing.
• Permits: You are solely responsible for obtaining all required local, town, and county building permits before installation begins. We will provide specifications and documentation to assist your permit application but are not responsible for permit approval or compliance determinations.
• Site access: You are responsible for ensuring our crew has unobstructed access to the installation site throughout the project.
• Utilities: You are responsible for identifying and marking all underground utilities prior to any ground work.

Installation and Timeline

Lead time from deposit to scheduled installation is typically 4–6 weeks, subject to scheduling availability, material lead times, and weather conditions. Installation is typically completed in 4–7 days depending on building size and site conditions.

We are not liable for delays caused by weather, site conditions outside our control, permit delays, or customer-caused delays. If your site is not ready upon our crew’s scheduled arrival, a rescheduling fee may apply.

Warranties

Our steel buildings include the following manufacturer-backed warranties:

• 40-year panel warranty covering chipping, peeling, flaking, and cracking of 29-gauge steel sidewall and roof panels
• 20-year frame warranty on 12-gauge Flo-Coat® galvanized steel tubing

These warranties are manufacturer warranties and are subject to the terms and conditions of the respective manufacturers. Warranty coverage requires that the building is installed on an approved foundation, properly maintained, and not subjected to modifications that compromise structural integrity.

Our workmanship warranty covers installation defects reported within 90 days of installation completion. We will correct any defects in our installation work at no charge during this period.

Warranties do not cover: damage caused by acts of nature beyond design specifications, improper use, unauthorized modifications, customer-caused damage, or failure to maintain the building appropriately.

Condensation and Moisture

Moisture inside a steel building is most commonly the result of condensation, not a roof or wall leak. This is a known characteristic of metal buildings and is not a warranty claim. Proper ventilation, insulation, and vapor barriers significantly reduce condensation. We recommend discussing insulation options prior to installation if you plan to use the building as a heated or climate-controlled workspace.

Limitation of Liability

To the maximum extent permitted by applicable law, Kirkmont LLC and Greg Builds shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services or website. Our total liability for any claim arising from our services shall not exceed the amount paid by you for the specific service giving rise to the claim.

Intellectual Property

All content on this website, including text, images, logos, and design, is the property of Kirkmont LLC or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from this website without our written permission.

Website Use

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. You may not use our website to transmit any material that is harmful, offensive, or violates any law. We reserve the right to terminate access to our website for any user who violates these Terms.

Privacy

Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

SMS Messaging

Kirkmont LLC, doing business as Greg Builds, operates an SMS messaging program to send transactional text messages to customers who have submitted a quote request or engaged our services.

• Program Description: By submitting a quote request form on our website, you consent to receive transactional SMS messages from Greg Builds. Messages may include quote confirmations, project updates, scheduling notifications, and appointment reminders.
• Opt-Out: You may opt out of SMS messages at any time by replying STOP to any message. After opting out you will receive one confirmation message and no further messages will be sent.

• Message Frequency: Message frequency varies based on project activity.
• Message and Data Rates: Standard message and data rates may apply depending on your carrier and plan.

• Privacy: We do not share your phone number or personal information with third parties for marketing purposes. Phone numbers are only shared with our SMS service provider as necessary to deliver messages.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts of Livingston County, New York.

Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page. Your continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
